What makes us know that it wasn't?
My guess is if he did rape her and got off, then he'd want no part of a civil suit. But if she falsely accused him then she should absolutely be within the realm of being sued for it. Otherwise there is absolutely no punishment for going around and making false accusations, which some "victims" do.
