But NCAA only gives out punishments to teams that aren't nationally relevant and passes the buck on the ones that are(see: Oregon)

I think he did this on purpose. He knows if he sits out this year he will be a top 10 pick, that may not be the case if he plays this year, so why risk coming back and being hurt or exposed? He is surrounded by SMART business people and the kid isn't stupid.

It's NCAA, not a US court. They don't need to meet a burden of proof, they just need to make their own decision on whether or not you can play.
