Pretty much we were told there is a difference between talking shite/threats vs putting hands/physically touching. He committed assault and battery. He can cry all day she assaulted him first. That’s irrelevant to his crime. They are asking him if he choked her, he is answering why he choked her.

Do you understand this part? She was no longer a threat when she left the room and she was attacked in the bedroom 10-15 minutes later. It would be one thing if he would have reacted right then. But he did not. The situation was resolved and he became the aggressor 10-15 minutes later. He can’t claim she was the aggressor anymore once she had removed her selves from the original situation. She also tried to
Reconcile by giving him more glasses. At this point she was no longer a threat. And he lost his temper and beat the shite out of her.

What a bitch.

She assaulted him and then when he was enraged she called the cops. They should both go to jail. He should have walk away and just called the cops. She would not have been arrested but the incident would have been documented.

They both have issues and should go to jail for this but he obviously went way over the top he is screwed and he will be crucified unless he can produce the tapes that will also probably incriminate him and probably only prove that she started a physical fight and probably escalated it physically way more then she would ever admit. But he will go down for this he is a male and she is a female. Should never be around or hang with a woman like that your only one with anything to lose.

Per the law you just copied and pasted, she assaulted him when she forcibly took his glasses out of his hands and broke them.

They both committed a crime.

He had removed himself from the situation for two days before she came into his spare bedroom and assaulted him.

Does not matter what happened 2 days prior, it’s totally irrelevant. Only thing that is relevant is he didn’t call the law when she was the “aggressor”. He then became the aggressor in a separate incident that happened 15 minutes later.

Great. So we’re in agreement that they’re both criminals and he should have had her arrested for being a domestic abuser.

Hell no. She never caused bodily harm or threatened to cause bodily harm. She took his glasses out of his hands. She was never a physical threat to him nor did she threaten him. It is never ok for a man to hit a woman, under no circumstances unless your in fear of your life.

That’s not the full definition of assault in Texas. It has 3 parts. You posted it yourself. She initiated physical contact by forcibly taking his glasses out of his hands and breaking them, in an act that she had no doubt would be provocative. That is assault, per the definition you posted.

Even if you consider this a “misdemeanor crime” that even was over with when they separated. No harm no foul. He wasn’t hurt, or attacked or felt threatened at that time. Or at least enough to defend himself. He then comes to bed and beats her arse 15 minutes later. End of story!! He’s taking the ride and the state will make sure of it.
