The Unassigned Lands were a portion of the Creek and Seminole areas. They weren't the entire areas.
They took a bunch of the Chickasaw lands and gave them to the plains tribes like the Comanche, Kiowa, Cheyenne and Arapaho and several others.
More to the point, if you southerners had won the war... none of that would have happened.
