Apparently the schools hearing officer has upheld the suspension LINK

In other news one of the kids I used to work with 4 years ago threatened to shoot up his class and kill another student at his current school. And I'm not even shocked by it. We couldn't suspend him if we wanted to when he was with us because he was labeled special ed.
I just want to know how these districts pull this shite off.

You can suspend him up to ten days OSS and hokd a manifestation meeting to determine if his disability caused it. If not then that kid is done.

That's what I'm saying. It damn near takes an act of God to suspend an EBD kid. Especially if his IEP was written up to include all kinds of stupid shite as his disability.
When we had trouble with him a few years back, he met his 10 days by October and his Mother fought alternative placement.
ETA: Nothing like a system that teaches little consequence for big behavior.
