In the vast majority of US states, there is absolutely no requirement for an attacker to be armed before deadly force in self defense is justified.
If a person has a reasonable fear for their life, deadly force is justified.

I think this is a case of a guy that carried a gun hoping one day he'd be able to use it. He could have easily fled from McKnight in his car, called the cops, and pressed charges.

Man this was a 180. I thought the guy was guilty but everything points to Mcknight getting out of his car. I'm just speculating but I'm pretty sure Joe was probably threatening to cause physical harm. Also the first shot grazed index finger and entered pointer finger and went to his palm. Seems like Joe might have tried to grab the gun.

yeah, and unless you had evidence that he was beating the shite out of you, you should be in jail for murder. Doesn't matter how "scared" someone is, unless you or your property(with you inside) is being violently attacked, you have no right to take someone's life.

None of that is an excuse to shoot somebody.
If the guys unarmed, on the opposite side of the car, outside of the door, and has to open the door to get to you. There's no way your life is in danger at that point.

It IS subjective. That's why investigators, DA's, and Grand Juries get to weigh in on these situations before they ever go to trial. And then a jury gets the opportunity to determine reasonableness as well. Overall, it's a pretty good system we have in place for this. Not perfect, but very, very good.

A reasonable threat varies greatly by situation and that is EXACTLY why there is no defined standard. Go tell a 120 pound woman getting beaten by her drunk 250 pound boyfriend that she has no reason to fear for her life.

McKnight was said to have been approaching Gasser and trying to get in his car. Sounds like those are pretty good extra facts if true.

He could reach for his weapon and point it at him and threaten him or
He could just hit the gas a little and the threats neutralized.
It's not like he can reach inside the car. Unlock the doors. Open the door. Jump in and start beating the shite out of him quickly. You would have plenty of time to shoot somebody by the time all that happened.

He can't pull him out of the car if the guy is at the passenger window while the shooter is in the drivers seat.
If he's at the drivers side window, my stance would completely change.
