What happens to a player being paid through NIL who commits scandalous/illegal behavior?

Is he going to be sued for damaging the brand?

How are these companies going to respond when some of the players they are paying are guilty of rape, domestic assault, killing kittens & dogs, etc? Will they sue the universities themselves, to avoid looking like they are going after 20-year-olds?

Not any different from when it happens with the "pro" athletes. The companies will just terminate the relationship.

They won't have any cause of action against the university.

They are getting paid by big business and tarnishing brands have always been handled quickly. Why would this be any different.

Players will get what they always get when they violate Universities personal conduct policy.

I hope I could help you with these emotional hurdles.

If you are waiting on the NCAA, don't hold your breath. They will eventually lay out a very broad outline. Mostly, not going much further than No economic inducements before signing an NLI.

The Transfer Portal, now that's a problem, and it will end up being a greater point of emphasis concerning future championships.

I agree..the transfer portal will allow for the flexibility the athlete/program needs to "shop" for their best situation.

Then the athlete will be in breach of the "morals clause" of their contract*, and the company will have several different legal remedies.

*I assume the vast majority of the contracts for NIL deals will have a morals clause, although some of the less sophisticated companies signing athletes may not take the time to draft/negotiate one.

What happens to the scholarship limit when boosters just pay kids enough to have everything the scholarship afforded them anyways? Now schools can just bring on 35 kids every year and pay the way for 10 of them
