The NCAA has no subpoena power, so Tunsil can basically tell the NCAA to screw off.
However, the staff member in question would come under the NCAA's jurisdiction. Either the messages are real or they are not. If they are not, then at the very least, it's grounds for defamation. I'm not a lawyer, but I would assume their are possibly criminal charges for hacking and faking someone's identity as well.
I think you almost have to pursue a lawsuit if you are Ole Miss as it is the best way to maybe regain control of the message (see last week and the Whole Food "Gay Cake" episode). I think if you don't do that, then there would be reason to believe that they may be real. That isn't saying that they are real, but it does make it seem to push the narrative in that direction.
It will be interesting to see what the university does in the next day or two.

Why? Ole miss doesn't have to answer to anyone but the NCAA.
And if tunsil needed that assistance...you can be assured that the NCAA has already seen it.
Why would we want to put out personal information of our current or former players like that?

Ole Miss has no legal standing to sue if it was Tunsil's accounts that was hacked. The staff members could potentially sue, but then they'd have to prove the messages were false to prevail on defamation. They also have to find the hacker before they can do anything

It's only against the law if the person actually altered software or exploits to get into the account. If it was his buddy next door who happened to know his password and logged in that way, it is not a crime. Now he could possibly have a civil case against the person if he can prove that it actually damaged him financially.
If you read the Ts&Cs of almost all social media outlets, they state plainly that your account is technically theirs.
Hacking becomes a felony if the hacker alters the software in any form or causes a DOS issue to a server.
Impersonating someone online is not against the law.

It's still a crime whether they happened to know the pw or not. Statutes will generally differ from state to state but it's generally any unauthorized use

I think most of us understand the NCAA is a crapshoot and Ole Miss may skate, but we like to give y'all shite about death penalty-level sanctions.

Riddle me this - if they're fake, but you misspoke on national TV and said they were real and you took money, how long would it take you to come out and recant? How many national talk shows and Sportscenters need to lead with this story before you clarify your comments?
The story is on CNN, Yahoo!, CNBC, etc. Does that seem like something you would want across the country if it wasn't true?
No comment that it was fake. No comment that he misspoke. Nothing.

You can't prove unauthorized use if they know the password. That's what passwords are for.

Agreed. They would have mentioned this morning they had the proper papers for financial assistance if they had any. Not saying they would release the specific information on the papers but just to say they assisted legally.
This could hurt their recruiting very badly and not making a statement of having the proper papers is telling me they don't have them. IMO.

When I say the university, I mean the staff member. I should have been more clear. Having dealt with this end of things at another uni in the past, while the university might not directly sue, general counsel would more than likely assist in the staff member's litigation in one way or another if they feel it is in the university's best (financial) interest. My speculation is that if they have a reason to believe a staff member has been a victim of fraud that in turn hurts the university's brand, they may find supporting a law suit to be in their best financial interest.
If I'm the PR flack involved, I'm definitely trying to find out how confident we are the messages are fake and at least mentioning a possible criminal investigation even if it isn't certain.
Truth be told though, I don't think they were fake.
