you're right, it is a crime; however, what this kid did would not fall under what constitutes a terroristic threat. under any statute in any state i've practiced.

We need to come to an agreement on what defacing really means. If you put something removable from a statue, I don't think that's exactly defacing it. Taking spray paint or a hammer to it, certainly. But going by this bar, I think we could say someone humping the Wall Street Bull is technically defacing it.

It is a public threat IMO, sorta like calling in a bomb threat

think the kid needed some jail time to get that bullshite out of his system. Going light on this guy would not have done him any favors and I certainly would not want to be the judge who let a racist jackass off easy in Mississippi.
Yeah, because getting his arse kicked daily by black people or joining the Aryan brotherhood for protection is really going to "get that bullshite out of his system". Instead he could have done community service and actually seen the plight of what minorities go through and sympathize with them.

Really bad act, but speech. His actions were protected by the First Amendment, but he pleaded guilty? No explicit threat to anyone and he was drunk when he hung the noose on the statue.

Thoughtcrime is now worthy of prison?
Wow... Welcome to 1984!
FTR, I don't agree with what the kid did, but likewise don't believe that any form of speech - no matter how abhorrent - should be criminalized.

If they caught the idiots who painted :black lives matter" on Confederate monuments, would they get 6 months? Note; not defending this idiot.

Yes, but it wasn't like he burned a cross on some individual black person's lawn. That would be a threat given the history of our country. This kid was drunk and did something stupid. No individual black person was threatened. Given that burning the American flag in front of veterans is considered speech protected by the First Amendment, this action would be too. Again, political correctness gone amok. Someone should talk to this kid; he doesn't deserve to go to prison for 6 months.

This sentence is absurd for the same reason that lengthy jail sentences for non-violent drug possession is absurd.
Gotta be intellectually consistent on this and he's an idiot but locking him up for six months is ridiculous.

Ole Miss decided to make an example of him it seems. The legal justification for the particular punishment (recognizing, of course, that he deserves to be punished in some other manner) seems tenuous at best. But Ole Miss has been embroiled in a PR battle to reclaim their image, and they found a way to send everybody a message.

Prison is ridiculous for something silly like this.

people REALLY need to stop saying Ole Miss had anything to do with this prosecution. The state of Mississippi didn't even have anything to do with this prosecution. This was a federal charge brought on by the Attorney General Eric Holder. Ole Miss' only involvement was kicking the kid out of school, which he deserved. The District Attorney of Lafayette County MS did not bring any criminal charges because the act did not fall under the required elements of any criminal statute in MS. The repeated ignorance of people making this about Ole Miss is getting old. That's not what happened. Yes this was absolutely a politically motivated move, but not by Ole Miss.

Some of you guys need to do a little more research!!!
Any of you calling for a lighter sentence and saying that he should not go to prison, do you realize that he also plead guilty to intimidating AA students and faculty earlier this year? In and of itself, the punishment did NOT fit the crime, however, when you look at this guy's track record he got what he deserved..

I totally agree. Ole Miss can't afford that old, racist reputation anymore. They are trying to compete athletically in the SEC. They already are getting negatively recruited enough now for racism, so they have to do anything to dispel those notions.

yes, he plead guilty earlier this year to the same crime he was sentenced to yesterday. The crime came with a max 11 year sentence and $100,000 fine. He was being prosecuted in federal court. He was clearly strong armed to take a plea and had an incompetent attorney.

There was no property damage and someone was making a point to please society. I am tired of the PC crap and this is another example. Kick him out of school and keep the money he paid. Put him on probation and make him do 200 hours of community service in the projects
