I think he put himself in a bad sitatuin but I don't think he DESERVES anything. Especially to be killed.

Imagine someone moving into your neighborhood. They knock on your door and tell you that they are a sexual offender. Even show you their electronic ankle bracelet. You ask what he did expecting the answer to be rape, child molestation, child porn, or something along those lines. And his answer is, "I was young and dumb and really drunk and I rubbed my balls on a passed out dude's head thinking it was funny". What would your reaction be? I'd feel sorry for the guy.

If you pass out in public in a rowdy place like that with tons of hostile people it's not a good choice. He doesn't deserve any of it though.
