Unfortunately for the NCAA, though -

“Considering the evidence currently before the Court, Plaintiffs are likely to succeed on the merits of their claim under the Sherman Act,” the judge writes.

This is great news for Tennessee.
This is the judge basically telegraphing to the NCAA that they're about to get reamed.
I would be surprised if they don't drop the shamvestigation in the next few days...something along the lines of "New evidence has come to light which leads us to believe no violations occurred".
To move forward now is to throw their last chance at surviving this into the trash can.
Poor Kirby, though.
He tried to cosplay as Saban but used his one biggie chit in a futile attempt to get NICO made ineligible.
He ain't no Saban.

Not to mention how detrimental and inconsistent they've been with waivers and suspensions of players. Remember the Missouri tutor? Or the kid who wanted to be closer to home cause mom had cancer?

All this will do is lead to even harsher penalties for Tennessee.

If things go UT's way on the 13th, as the judge's comments seem to portend, it will become illegal for the NCAA to pursue the investigation of UT.
Dumbass.
And right now Kirby is praying that the NCAA drops the shamvestigation. If Discovery goes forward, any emails between him or his staff and the NCAA guys will be made public.
And Nico's lawyer just whispered, "antitrust damages are triple the harm".

If the judge rules in Tennnessee’s and Virginia’s favor, the NCAA won’t be able to lawfully punish Tennessee for this unless they have a kink for paying millions of dollars in fees and sanctions in a slam dunk lawsuit
