Jack Daniels is all about protecting their brand. They sued Dickel for trying to use Tennessee Whiskey on their label and then got all butthurt when Uncle Nearest launched a few years ago.

Didnt Aggy University file a lawsuit against the Seattle Seahawks over the same thing? Both are stupid lawsuits

I’m no legal experts, but does JD have a leg to stand on here? It looks as if the dog toy bottle, font and design is different than that of JD.

12th Man = 12th Man...and "Aggy" won.

FWIW, no one has ever attempted to infringe on an Arky trademark.

I'm a proud Tennesseean and I love my home. However, we do have assholes ruining it. Mostly these uppity Yankee transplants and gay West coast hippy ads wierdos.

Look up the Tennessee trash video the state made in the 70's. It's on YouTube and it's hilarious. Sorry can't link it.

But...maybe Jack Daniels can learn from this. Brand protection isn't that important. They can take a que from the famous Texas whiskey...I forgot the name...but I'm sure you know the one I'm talking about. What is that world famous Texas whiskey brand, again?

The ultimate issue is whether consumers will be confused or deceived by buying the allegedly infringing trademark brand because they think it's the trademark holder's brand.

In my useless opinion, it's a hard sell to convince a court that customers buying a dog toy that looks like a Jack Daniel's bottle are doing so because they thought it was a dog toy branded by the actual Jack Daniels company. To me this is a classic case of trademark parody which is allowable.

When famous brands become the object of the parody, there are legal risks. Is the would-be parodist commenting on the famous brand, or just using it to call attention to their product. Do consumers believe the parody product is made or sponsored by the famous brand owner? Is the parody tarnishing? If the answer to any of these is "yes", then JD could have a successful claim.

Can they show that the toy is insulting/tarnishing their product by referring to it as excrement? Maybe...

I agree that Jack Daniels old number 7 is essentially shite.

It got made known early and became a cool liquor despite the fact that it tastes like a hillbilly's a-hole.

Many cheap as frick liquors taste a helluva lot better than that camel piss.

Crown Royal is the same way but at least it tastes better.

It is mainly about just how cool you want to seem.

I have 70 year old friend that drinks JP Weiser every day around his local friends but when he has out of town friends around he will fill a Crown bottle with Weiser....good dude but pretty fricking pretentious.
