In Alabama you can be charged with murder for many things. A friend’s nephew was with a group of kids who were committing minor vandalism and someone came upon them, fired a warning shot into some bushes to stop them. The problem was, there was a kid in the bushes who was killed. The nephew was charged with murder 2d degree and did time because they were in the act of committing a crime. The man who shot the girl was not charged.

Would he have been charged for murder if his "warning" shot(s) into the bushes killed any of the vandals?

This would only be similar to the Miles situation if Miles was actually in the process of committing a crime. He could have been, but right now we don't know that for sure.

There was an incident on the Jefferson/Walker county line around 40 years ago, where a truckload of teenagers decided to do donuts in a person’s yard. The property owner stepped out onto the porch and fired his shotgun into the air hoping to scare them off. A pellet deflected off of a tree limb and struck one of the teens at the base of her skull, paralyzing her instantly. Investigation was done, nothing came of it but the property owner had to live with that incident until he died just a few years ago.
