Maybe it's just me but, if a law enforcement officer believes, sounds both arbitrary and draconian.

So theoretically the blood alcohol limit isn’t the ultimate litmus test? Even if only one beer was consumed and under the limit they could say DUI less safe?

May as well just make alcohol illegal.

They will always use the argument that even drinking anything before driving theoretically makes you less safe.
