I once got paddled in middle school for laughing at a guy getting paddled so yeah, you can def. get in trouble for being the smartass who laughs.

I got fired for laughing...of course I was an intramural ref and laughed at a coworker who was reffing our football game after he said "football is a non contact sport"....he let some idiot tackle a guy which resulted in torn acl.
