Man, if the $20 tree statute is found to be on point...there is gonna be some pissed off folks..

I'm sure Alabama state penitentiaries don't have room for the likes of Harvey Updike. There are real criminals out there that are violent that need that jail cell more than Harvey.
If Auburn fans had to choose between putting Harvey in a cell or putting the guy that just shot 3 Auburn (ex)football players, who would they choose?

But even if so, that would be for the trees themselves, not the neutralizing of the chemical, removal and repair to the area

Obviously the if given the option between the two, one would go with a violent. But we jail non violent criminals as well. one should just be there longer than the other

You're fricking dumb.

But what if the difference is enough to knock it down to CMII? That would mean he would go from a Class C felony to a Class A misdemeanor...from up to 10 to not more than 1..

Shooting 3 people and tree murder are two distinctively different crimes. Both involve "killing", only one, and I'll let you guess, is deserving of jail time. The other should be punished with a full chest tattoo of cam newton and the score of that years Iron Bowl, Made to sing the Auburn school song, and must stand on Toomers corner and get rolled while in full AU gear.

Yes we do, when there is room for them or they are a threat to society.
Give the guy 90 days in jail. He'll do 30 days. 2 years probation and a fine. All of these idiots suggesting years in prison need to be slapped.

You could sell the trees to a hardwood flooring manufacturer, that'd recoup some of the money.

Yes they have. It's widely known that Auburn fans have to share brains sometimes when there is a shortage in the area.

quote:You aware of case law that specifically defines what is included in calculating the damage under CM1? If it is merely the value of the trees and that statute applies, you may be right, but I believe the removal of the tainted dirt to prevent further damage exceeds $80,000. Not sure if that will be included or not.
But what if the difference is enough to knock it down to CMII?

they've already spent 80k + on dirt removal, So I'd say he is already there

This is their argument, and that is why I said folks would be pissed.
