He was never convicted of a crime. He was arrested and charged in Texas in 1996 and 2004 for criminal mischief and theft, respectively. Released within a few days each time, no trial, no conviction.
ETA: inb4I'mDefendingHim... Just saying his prior "felonies" don't really hold water.

Sentenced to allow the War Eagle to land on his face for Auburn home games.

I was just going off of what someone else said in the thread. I hadnt heard of any previous arrests until then, so take it for what its worth.

I just wasted my 20k post on a Harvey Updyke thread.
I looked this morning and your 20K post was "Lemonier..." so it's okay

Per Auburn University.
I didn't know he had previous felonies. Do you have a link for that ? I know he was an retired Texas State Trooper.
Also, I can't find whether or not it was 4x's the amount to kill a tree or 80x-100x's the amount to kill a tree. :-( Do you have a link for that too ?
ETA: He turned down his plea back in January.
His plea deal = 13 years in prison, and never be able to go to an UA game, again.
13 years is absolutely fricking retarded.

Tebuthiuron is toxic but not lethal to animals.
ETA: Anything can be lethal giving specific circumstances.

I beleive it was their press conference, but here is another statement
quote:
Auburn said test results indicated the herbicide levels found ranged from 0.78 parts per million to about 51 parts per million. He said studies have indicated that "100 parts per billion was toxic to some species of oak trees."
so if .1 part per million(100 per billion) is toxic and they found levels as high as 51 and low as .78, thats 8 to 510 x's the leathal dose

Under Alabama law, if convicted, Updyke could face up to 10 years in prison for each felony charge and as much as a one-year sentence and $2,000 fine on each misdemeanor.
Harvey faces a max sentence, of what, 40 years in prison and $4,000 fine ?

Meh, thats the DA looking for a quick homerun to insure re-election down the road.

Well duh.
You can die of water poisoning. I was just pointing out some posters made it sound like he could have killed so many things other than the Oaks. Which I'm not sure is true.

FWIW, I was not saying that.

More than likely, the dude is gonna get a sentencing that is probably longer than he should.
Oh well, if you're that dumb. You have to deal with the repercussions. Especially, telling on yourself.

Well, Im no tree poison expert but that was my assumption.
IF it,s not true, I think that will lessen his punishment. If it is true that the extreme large amounts that he used COULD have hurt others, then it will be worse for him.

Historical significance or any significance for that matter will be looked upon differently. Apparently, he did not poison "any" tree. He did it with an intent to hurt/affect the whole population associated with a university in some form.
I guess there will be a lot of discretion used in his sentencing that can set a precedence for such act if there's not one. A year in jail is not too harsh, IMO. This will stop people from vandalizing things that matter to a large population.

The crazy thing is his misdemeanors are "desecrating a venerated object"
No one legally cares that people looked at the Oaks like that. It's all a property issue.

A very low probability that it would move to the water supply in sufficient quantities to cause harm. The feds are still evaluating as that is a federal crime.

This is true. It's a urea-based compound which means 99%+ of animals can somewhat safely metabolize the chemical without long-term effects, but some (small percentage, but they exists) people can be very sensitive to compounds like these, and that's where it gets serious.
