Well, from a defense standpoint, his call-in to the show told everyone listening what the poison he claimed to have used was...so anyone "could" have gone down there and used the poison after the Finebaum call...the soil wasn't tested until AFTER the call, so there is indeed a "reasonable doubt" to be brought up (this is what I suspect his lawyers case will be)
The real evidence is that he made additional calls to the Auburn professor, who then tested the soil, found the poison, and the phone records were traced to Updyke. He won't be able to shake that one...

If you listen carefully, he said THE PHONECALL was the worst mistake of his life...he and his lawyer are going to play the angle I mentioned above, that someone else heard the call on Finebaum and did the actual poisoning.

No he isn't. This will and in a plea bargain. There is exactly zero chance he actually takes this to a jury. The soil samples were taken the day of the Finebaum show and sent off. No chance for anyone else to have done it.
