Incorrect. Under Georgia law, reckless driving kicks in when you violate the super speeder provision (75+ mph on a 2 lane road or 85+ mph on any road) of the speeding statute. It is automatically an arrestable offense and is the officer's discretion as to whether or not an arrest is made. It can also apply when a driver disregards the safety of persons or property.
IOW, he could have been doing 90 on the Loop and the officer decided to arrest him. Or he could have just gotten the super speeder citation.

Athens police met with Kirby and the team in MARCH to learn about the dangers of drag racing.
Smart told reporters "The issue was not to be taken lightly". "I think our guys understand that and we continue to educate them and we will continue as a university to make sure they behave and do that in a proper way".

Racing has multiple definitions. Legally, they were not racing.

His 6.2L Hellcat engine does not have a governor on it. 707-840 hp with 650 lb-ft torque.
