Bald Eagles are no longer endangered.

The USFWS delisted the bald eagle from the Endangered Species List on August 9, 2007.

They are just another bird now.

Deal with it.
That's not how that works. They're still a regulated species, you moron.

I did *ahem* meet some smoking hot chicks from Phenix City once. I did not believe them when they told me where they were from.

Most likely... they didn't graduate high school if they're from Columbus.

I hold a federal migratory bird permit and have for years. I'm familiar with regulated species of the avian variety. There's nothing evil about this developer clearing trees for a development, just because some hippies say there may or may not be a pair of eagles nesting in the forest. If that's the standard, nothing ever gets developed ever again.

Yeah, everyone who hunts any migratory bird; doves, ducks, geese, etc.; has to get one. Buying a hunting license does not make one an expert on eagles.

You don't have to be an expert on eagles to know they are no longer endangered. But, having that permit assumes you know the laws about when you can or cannot shoot them. I was accused in this thread of having no idea about federal migratory bird regulations. I simply replied to repudiate that falsehood.

Stop conflating the issue. Stop obfuscating.

If you think the developers did something wrong LEGALLY, please articulate it.

Please tell me, when are we allowed to shoot bald eagles?

Why can't I cut down some trees on land I own? Because a non-endangered species might or might not nest in those trees?

FWS.gov - National Bald Eagle Management Guidelines

quote:

The Eagle Act prohibits removal or destruction of both active and alternate bald eagle nests. Bald eagles exhibit high nest site fidelity and nesting territories are often used year after year.

Both the Eagle Protection Act and Migratory Bird Treaty Act would apply in this case I believe.

quote:

Cutting of bald eagle nest trees continues to be a violation of federal law. Although the species no longer enjoys ESA protection, both bald and golden eagles are unique in the United States in having their own federal law (the Bald and Golden Eagle Protection Act of 1941, commonly referred to as the Eagle Act)

quote:

Whoever violates any part of the EPA may be fined up to $250,000 or imprisoned from 1 to 2 years or both.

quote:

The Migratory Bird Treaty Act (16 U.S.C. 703-712), makes it unlawful “...to pursue, hunt, take, capture, kill, attempt to take, capture, or kill, or possess, ... offer for sale, sell, ..., any migratory bird, any part, nest or eggs of any such bird...” Violators may be fined up to $250,000 for a felony and/or imprisoned up to 2 years.

It is illegal to remove or destroy a bald eagle nest. Which the developers clearly did. It is a felony.

If you cut down a tree with a bald eagle nest or red cockaded wood pecker nest in it and the feds find out, you will find out why.
