This may be a federal issue seeing as how it is a monument or on a state-owned campus. Too many factors for me to GAF right now.
Basically, they'll be prosecuted because Dan Jones hates anything remotely racist but the prosecution may not have anything to hang their hats on.

They'll get them on something. I wouldn't expect any prosecutor to be looking to send them away for 10 years or whatnot but I'd assume that even if they had to get creative in charging these creeps they'll get them. It's one thing to do something like this at Lower Iowa State but when you choose to do it at Ole Miss to this particular statue you're making a big statement and I'd expect that statement will be met by an equally big one from prosecutors.

If this was in a busy part of campus and people heard them saying racial slurs how did no one of up and confront them or record them with their phones? Seems like a conspiracy to me.

Not sure if that would make it worse or better. OTOH, frat kids are dumb but on the other it's pretty sad to think of any frat kid thinking this was ok. I'd almost rather it be a bunch of old racists who just picked OM as a target because then it's not racism living on in younger people.

It doesn't fit the "old racist" pattern though. The old unashamed racist would do it at 2pm on a Saturday in white robes with a bullhorn. Early morning raid seems more like drunk fraternity guys. It's still bad but not the end of the world and I don't think any less of OM for it. We had smaller incidents at USC when I was a student and they were just as immature and passive aggressive but they got NO media attention or offers for rewards because it wasn't Mississippi.

Basically, it depends on if the statue is deemed a part of the "school house" or "public building" and how much the "damage," which is minute at best, is worth. Miss. Code Ann. 97-17-39.

No, I wouldn't blame OM for it. Ole Miss in general has accepted the fact they've got their burden to carry (we all have one of some kind) and most young folks are happy to try and right the wrongs of the past and just work for a world we can all get along with no matter our skin tone. And of course, OM's a target for both old school and new school racists thinking "here's the place I can make a statement!"
With the drunken frat boy scenario... it speaks to unresolved racial issues and the passive aggressive bully nature of some. Not old school like you say/point out but new school. That said, I wouldn't excuse them because of the bottle - this isn't x got drunk and said every bad word he knew and didn't remember it' but something that requires a lot more thought/less impairment. There might've been liquid courage involved but I don't think it was to the point where they were out of their heads.

Thanks. Can they get them for trespassing or even criminal trespassing as well? I know UT pulls out that charge sometimes when students or strangers are going too far with shenanigans on campus.

I hadn't thought of that angle, to a certain extent yes, it would reveal some underlying issues. Not sure which is worse.
