Oh lord knows I have too. I have also got into cars when I knew my friend was drunk. And if he would have killed me in a wreck I would absolutely hate it if my family or others blamed him for it.

i don't think anyone has implied that at all. However having a BAC that is fatal to some people is absolutely a poor decision and can very well lead to dire consequences. It's also a poor decision to get in the car with someone who is driving drunk. Maybe he was too drunk to make the decision to get in the car, but again that is essentially his fault for getting to that point where he was too incoherent to make a decision. I think the moral of the entire incident is don't drink and drive and don't let yourself become so drunk that it becomes a potential danger to your health. It doesn't make him a bad person at all and is very sad, but lessons can definitely be learned from all of this

I personally advise everyone to just step away from this thread. It's a sensitive topic, and from what I can tell, everyone is misunderstanding everyone else.

Who cares what is BAC level was. He wasn't driving. This had no business being published.

I'm sure it was taken as part of a standard report for any possible future tort actions on Lutz's behalf. Basically just getting all the facts of the incident to determine liabilities of the parties involved. It would absolutely be evidence admitted if there's any sort of wrongful death suit filed at a later date. Publishing it may have been public by standard practice, that I don't know. If it wasn't proper to publish that report, I'm sure Lutz's family would have grounds for an invasion of privacy suit against the reporting agency.

Most everyone has drank alcohol and drove at some point in their lives and people will continue to do so. It's very common and it's tragic because it's extremely dangerous and puts not only your life but others lives at risk. But Let's not act like everyone here that drinks always has a DD. They should and it's the most responsible thing to do, but it doesn't happen all the time.

I am 33 years old. I have been drinking since about the age of 16. I quit drinking this year. With all that said, I always made a plan before going out. If I was to drink at a party or a friend I always had a DD. If that DD got wasted....we called a cab or slept in the car. There is never a situation I was put in that required myself or a friend to drive us drunk. Always have a cab available.

That's great. Everyone should do that. But I'm just saying that doesn't happen that often.

The most common reason why is that it's an inconvenience.

But people should think I could either get killed, kill someone else, or you'll get a DUI and pay a hefty fine and have it go on record.

well that is very responsible of you; however, that is more of an outlier than the norm for kids in that age group. it's a sad but true reality. i absolutely never drink and drive now and won't get in the car with someone who has either. my career and life is worth the 15-20 bucks a cab costs; however, when i was in college that wasn't always the mindset i had. i never got a DUi and I honestly didn't have my wakeup call until two of my best friends were in a drunk driving accident (both having prior DUIs on their record) and one of them lost his life. I vowed from that day forward I would never put myself in that kind of situation again. Some people, however, never have that wake-up call and it takes a tragedy like this before they "wise up." very sad

After watching the videos in high school and having a few friends die at the hands of alcohol and driving. I always took that stance pretty seriously. Had a girl I knew killed while driving drunk, another buddy same thing, a friend I grew up with killed by a drunk driver...etc. If people party at my house they don't leave without a DD. I take keys if I have to. Alcohol and driving is a very dangerous thing to play with.

Depends on where you live as well. Obviously in Louisville there's tons of options, but I've been out in the sticks where a cab isn't readily available. And as said, some people hold their liquor better than others. For all we know the DD could've gave the impression he wasn't drunk.

I know a very close relative/friend who tested .34. For severe alcoholics its a walk in the park. For people who are normal functioning human beings, you are beyond shite-faced. Lutz was wasted. I knew he partied like every college aged student so this was no surprise to me. Still an awesome guy.
