Here, JFF is in the clear. He did not enter an agreement with Fitch for the above. Next
(b) Seeks to obtain any type of financial gain or benefit from securing a prospective student-athlete’s enrollment at an educational institution
Has nothing to do with the enrollment process (NEWTON )
or from a student-athlete’s potential earnings as a professional athlete.
Had zero to do with that.
Application:
An agent may include, but is not limited to, a certified contract advisor, financial
advisor, marketing representative, brand manager or anyone who is employed or associated with such persons.
None of that has been met.

I think most would agree that a rule that allows everyone and their brother to profit off of the name Johnny Manziel, except for Johnny Manziel himself, is wrong. I know it would hurt A&M and JFF likely would be ineligible, but part of me does wish he'd step up and say, hell yes I did, and there's nothing wrong with it either and see if he can't force a rule change. Lord knows he already has the $$$, the notoriety, he's going to get drafted regardless, and he's certainly cocky enough to do it. I just think the rule is bullshite and until someone forces a change, it won't change.
Having said that, it won't and probably shouldn't happen, for A&M and JFF's sake.

IIRC, Auburn ruled Cam ineligible and the NCAA reinstated his eligibility right before the SECCG... all took place on the same day.

Yes he was. But not for any listed purpose under the NCAA guidelines that you sited or that is located with section 12.
Again, the loophole with Cam was for the enrollment process. It was to add who to the definition of an agent. This is going to deal with the known description of what Fitch was to JFF.

Auburn suspended Cam for a day, then the NCAA re-instated him before the UGA game. That was why there was no QB named as the starter for the UGA game until it was announced in the stadium.
