It's common knowledge that Texas A&M will sit JFF for the first three games as this plays out. They are doing the smart thing here.

Plus Manziel isn't going to sue anyone. That would give the NCAA subpoena power, to find more evidence against him. No way he wants more of this.

If he's guilty, and the NCAA can somehow give sufficient explanation that A&M *KNEW* he was guilty, then they will be forced to forfeit games and probably very heavy sanctions.
If he's guilty and the NCAA cannot show or give reasonable cause to presume A&M was aware, then they will likely vacate wins instead. If they are demonstrated as being incompetent in their investigations, the sanctions though will be severe - if they are shown due diligence, then minor (if any) sanctions will arise, but 2013 will be a bust.
If he's guilty but sits out during the investigation, A&M goes into battle sans their Heisman winning QB. Even so, they pull none of the best East teams, and have an absurdly easy OOC schedule. Even without Manziel they'll win 8 games, minimum, IMO.
If he's innocent and sits, then they potentially lose those games for nothing.
If he's innocent and plays, then the season goes ahead as everyone expected it to a just a few months ago.

Let me lay this out in a 2 pronged effort for you Aggie fans.
1.Here is how A&M and Sumlin should/better handle this case.
They should bring JFF in and tell him point blank, look we aren't going to play you as long as this NCAA investigation is ongoing , which might be all year , so you sit all year or you come clean and tell the truth, pay back the money and we will propose a 2 game suspension ( probably be 4-6 ) and then after the suspension is over, you can play.
2.Scenario # 2 , the Reggie Bush syndrome , unlike Cam Newton, whose father asked for money, thereby technically tying the NCAAs hands , if any disgruntled agent / autograph dealer comes forward in the future a la the USC / Reggie Bush case , TAMU will , WILL, WILL get hammered by the NCAA, which is why the 1st alternative I set forth above is the way to go.
Don't let yourselves be fooled because of the way the NCAA handled the CAM NEWTON case , the father would have had to roll on the son , the NCAA by the way has since changed the by-law and a father seeking payment for a son is now an infringement.
