If they would that would mean impeachment, which is the current process for charging presidents would be voided. Any DA/state could indict a president and force a trial. This would blow up the way presidents are dealt with by Congress. Biden could be indicted by a red state DA right now and be forced to stand trial while in office .

Clearly someone hasn't read the actual Constitution

You think DeRosier would have brought some charges against Biden if he were still around. I could see it getting wild!

Clear separation between impeachment (the political remedy) and prosecution (the criminal remedy).

It sounds like they are going to make a distinction between private and official acts by the president.

Which was the expectation of the non-crazies.

Then the next analysis is assessing which group Trump's various behaviors fall into.

Whether or not immunity exists isn’t the question. The limits of that immunity is what the Court has to parse out.

Correct. Which I previously believed was common sense, seeing as that distinction is present in every other type of legal immunity for public employees/officials in the entire body of law of the United States.

The issue has always been whether whatever actions Smith is relying on are within POTUS’s official duties.

Which Justices phoned you and asked you your take on the case?

No it wouldn’t. Impeachment and legal proceedings have zero connection in any way. Neither has any relation whatsoever to the other.

When the Supreme Court proves you wrong, you can come back here and apologize for having ump-teen doses of TDS.

List all the presidents and judges that have been criminally prosecuted for doing what Trump has done. This has little to do with presidential immunity and everything to do with that

Go back and read the section you quoted:
"but the party convicted shall nevertheless be liable and subject to indictment, trial, judgment and punishment, according to law."

Trump was not convicted by the Senate. If he had been, he would have been removed from office.

Lol are you suggesting other Presidents haven’t “taken classified sensitive documents”? Paid off potential embarrassments? You can’t be serious
