Brother in law got arrested for bui on lake lanier bit said initial stop on jet ski was for boating after dark. I'm wondering if there is a set time or just like dark as in 8:30 or so. I ask because first call from jail came at 8:15 so wondering if he was lying considering it takes time to get pulled over. Tested. Arrested and booked.

boat sober or get pulled over.

He was probably lying because, while Lanier is dangerous because of so much boat traffic and the cops are pretty much unforgiving for BUI, they're not unreasonable. At least that's my experience. If he had been sober I'm sure it would not have been as dark as it was because he was drunk.

Forgot to mention passed both field sobriety and breathalyzer. They suspected drugs. Of course. He had those problems in the past. Cocaine and heroin but mainly other ppls prescriptions. Things just aren't quite adding up. But they have done bloodwork and he got bailed out at almost 2 grand

Probably saved your brother in law from killing him self on it

If he was on a jet ski he wouldn't have had the proper marker lights for late night boating.

Also the police, dnr, etc.. on Lanier are cool so something is missing here

IF I remember correctly (big if) you are required to have lights anytime after whatever sunset is for that day
Pretty sure that's correct so considering the time it would take to get off the water, processed, in jail, etc that story sounds like bullshite to me
Though really the reason he was pulled over is relatively inconsequential to whether he was fricked up or not IMO
One big difference between the water and the road way is that wildlife police DO NOT need a reason to stop and check you. They can do it for pretty much any reason at all including just random inspection (in MS/TN/AL anyways)

boaters who dont know the rules are the devil. People will let anyone ride a jetski without given any wisdom beforehand. However, I see boaters routinely doing the same boneheaded things

Boaters will learn when they have to get a sea taxi.

As NYC mentioned, most jetskis don't have proper lights for night boating. I'm guessing they pulled him over because it was close to sunset and Lake Lanier is dangerously low in some areas right now. They probably just wanted to advise him that it was time for him to be on land, then started to suspect he was under the influence.

To start with, frick your brother for drinking on Lake Lanier and boating period. Place is a zoo already and its the reason there are so many deaths on Lanier every year
For your lighting question, Jet Skis must be off the water 30 mins before sunset. Even if he had a basic light, it would not fit the recommended hight for a stern light that is required by GA law.

Night Time Navigation
You should always be on the lookout for the lights of other boats when boating at night. Several types of lights serve as navigational aids at night. They are:
Sidelights These red and green lights are called sidelights (or combination lights) because they are visible to another boat approaching from the side or head-on. The red light indicates a boats port (left) side; the green indicates a boats starboard (right) side
Sternlight A white light seen from behind the boat
Masthead Light A white light, which shines forward, located on the mast of a sailboat and required on all powerboats. A masthead light must be used by all boats when under engine power. The absence of this light identifies a sailboat under sail
All-Round White Light On powerboats less than 39.4 feet in length, this light may be used to combine a masthead and stern light into a single white light able to be seen by other boats from any direction. When sidelights are extinguished, this light serves as an anchor light
