The constitutionality hinges on the poor wording. The law, as it’s written, says “school employee,” and doesn’t limit that in any way - by job title, type of school, or even location. So, a 22 year old bus driver in Mobile is committing a felony by having a relationship with an 18 year old senior in Huntsville, which is asinine. There was a case a few years ago in which the judge ruled the law unconstitutional, but that ruling was overturned during the appeal. It needs to be tossed and rewritten. It’s an incredibly weak law as it stands, because of the ambiguity, and that’s why the majority of these cases get tossed out.

Just as an FYI..... the link above states the following:

I wonder if the people who designed the Walk of Champions back in 2006 realized the kinda hell they were going to put the maintenance crew through if somebody were to come along and start winning NCs every 2.5 years?

You're going to need to provide some stats to support this statement when it comes to Alabama.

Based on my experience (which was 18 years with a prosecuting agency), most take a plea to avoid the embarrassment of a trial.

There were 3 in Tuscaloosa County alone that were tossed 2015-2017, two others tossed around that time frame - cited in the article I posted. There have been many more. I’ll provide links in just a bit. In the air currently.
