Last week, the Biden admin announced they're considering a vax passport in order to travel from one state to another.

Security checkpoints would be stationed at all roadways where they cross state lines to check for your papers, vax card, etc. They've decided not to implement this "at this time".

This announcement was a "test bomb", whereby it's purpose is to test the public's reaction. You can bet that some time, soon, it's coming.

very unconstitutional, but in today's political climate, wouldn't shock me for judges not to care

Restricting inter-state traffic is illegal, isn’t it?

You'll never convince me that these people aren't trying to start a civil war as a means of destroying the country.

How does a lawsuit about collecting a tax on people leaving the state pertain to this situation? Was there something in there about not allowing people to enter and leave a state freely?

yes

quote:

But I am of the opinion that the right of persons to move freely from State to State occupies a more protected position in our constitutional system than does the movement of cattle, fruit, steel and coal across state lines. While the opinion of the Court expresses no view on that issue, the right involved is so fundamental that I deem it appropriate to indicate the reach of the constitutional question which is present. [314 U.S. 160, 178] The right to move freely from State to State is an incident of national citizenship protected by the privileges and immunities clause of the Fourteenth Amendment against state interference. Mr. Justice Moody in Twining v. State of New Jersey, 211 U.S. 78, 97 , 29 S.Ct. 14, 18, stated, 'Privileges and immunities of citizens of the United States ... are only such as arise out of the nature and essential character of the national government, or are specifically granted or secured to all citizens or persons by the Constitution of the United States.' And he went on to state that one of those rights of national citizenship was 'the right to pass freely from state to state'. Id., 211 U.S. page 97, 29 S.Ct. pages 18, 19.

I think SCOTUS said in this case a "State cant limit people from another State" to move freely from one state to another. A state can only police its own border.

In addition, the mere act of a person travelling from one state to another likely also gets into Interstate Commerce in the next state, or if someone drives straight through one, eventually it will when they stop for gas, food, lodging, etc.

And yet, showing an ID card when you vote is considered bad.

Your vote which has a huge impact on everyone's lives = not important enough to need an ID for.

But a virus that is so deadly you have to get tested to know if you have it. Well, you better bring out not only an ID card, but also your fricking medical history.

I don't give a shite what "side" of politics you are on. If you think this kind of shite is ok, then frick you.

I have serious doubts that requiring proof of vaccination to cross state lines is something that would be upheld by the SCOTUS (especially this particular SCOTUS), but when it comes to commerce clause interpretation you really never know. It's arguably the most elastic segment of the entire Constitution after the 14th Amendment.

The fact you think this pretty much highlights you're one of those idiots who treats politics like a team sport.

Dumbass.
