City of Auburn evicts students in certain neighborhoods

So the city of Auburn has a new ordinance or are just start to enforce an ordinance that bans more than two unrelated persons from living in certain neighborhoods in town. Students were served with eviction papers from the city within the past two weeks and we're given 30 days to vacate.

Thoughts?

They've always (for awhile at least) had the ordinance. They historically enforce it anytime there is a complaint made. The typical way the city can know of the infraction is if a complaint is made and/or police contact reveals info

The parents who own the house are at fault. They send out a letter every year reminding homeowners of zoning rules for their property

Alternatively, they could just reduce the # of people in the home to 2 unrelated people and make the others find a new home

Probably a large number of affluent residents complained about college kids partying near their homes.

Seems to me that's just something you deal with living in a college town, no need for city intervention.

or the parents could adopt all of the roommates or 2 roommates could marry and adopt the other roommates. Lots of creative loopholes

I'm sure it ebbs and flows. Some kids are calmer than others. Probably just getting rid of a few that got too wild

I'd probably just let if go and let them live there since it's a college town. But I also think they shouldn't be whining about a rule that's been in place forever being enforced.

I assume you are being sarcastic, but reducing the number of occupants to fit zoning rules isn't "creative loophole" it's getting in compliance with zoning law


I have no sympathy, the zoning laws are publicly known and they send out notifications every year. If you assume the city won't enforce the law, you run the risk of being evicted

The law doesn't cover just students, it also protects against things like "crack dens" a la Jesse Pinkman in Breaking Bad.

The city planning decided that the city would benefit from residential neighborhoods that were isolated from the university student population. There are a lot of good reasons why people wouldn't want student rentals in their residential neighborhood that arne't noise related


I'd point out that zoning laws aren't unique to Auburn. They occur in every city with anything that resembles city planning. There is commercial zoning, residential zoning amongst a bunch of other things

Especially since whatever lease they signed probably mentions it.

Or, conversely, if the leasing company allowed 5 unrelated people to sign the lease knowing the ordinance, then the leasing company is also at fault.

Methinks either (1) the students didn't read their lease before signing or (2) they DID read their lease and are just playing the victim.

I received a post card from the city a month ago as a reminder of the regulation. It protects property values and homeowners who don't want their neighborhoods to become mostly rental units.

The story I saw the other day was that one girl's parents own the home and renting to a group of friends. I guess they are claiming ignorance to the ordinance

So the owner is claiming the ol' "I'm ignorant of the law" excuse, eh?

I'm guessing not all of them signed a lease and I know all of them aren't going through a leasing company.

They're doing what I did at Auburn. My parents owned a home in Auburn. I stayed there and had friends live there. They pay rent but never sign a lease. I have a place to live. Parents have a place to stay for gamedays. Rent from three roommates help cover costs.

Some peoples parents also buy the house with the idea of retiring there

Good advice for home/property buyers: Know the zoning laws/ordinances in the area for which you are buying.

I mean city hasn't rescinded the eviction notice so it isn't working. I guess they are hoping to shame the city. Good luck, local residents DGAF about AU students if it adversely affects them

I would never let anyone live on my property without a lease. Must have really trusted them, which goes against the whole "never trust other people with your money/property" rule
