That's pretty much exactly what happened with jeremy hill. The la law makes it not statutory rape under those circumstances. It's a misdemeanor and he won't go on the registry

Rough night for Emmons as his team lost in the playoffs, but the other team stacked the box on him and he never gets a break as he plays in about every situation.

That also ensured he stayed in state for college.

Same thing in AL. The code is on the money for statutory rape. It always gets dropped to sexual misconduct. Even in my conservative JD.
