Speeding Ticket in Mississippi- Looking for any help

Hey all. New poster, haven't ventured to the OT board much. I'm a student at State and got a ticket for 92 in a 65 on Highway 25 a couple of weeks ago. I'm aware of how idiotic that kind of speed is, and legitimately feel bad about it. The court date is next Monday in Leake County.

Most of my friends from MS say that as a first time offender I should just get traffic school and have to pay an astronomical fine to keep it off my record. The only catch I see in this is that I have a Missouri License, and I don't know if that makes me ineligible or if it keeps it from being reported to Missouri, and therefore insurance. Anybody have experience with a situation like this? Is it too late to try and call a lawyer?

From the sound of it, you've already admitted guilt to the officer, no? If you didn't state to the officer you know you were speeding, then you could require them to provide proof of calibration of their radar in the past 6 months. Also, case law supports requiring the technician that calibrated their detection devices to be present during your court date, so that's another avenue.

Also, I don't know the laws surrounding reckless driving speeds in MS, but another alternative could be to get your speedomoter calibrated (definitely works if you have oversized tires). That could possibly bump the points down. A speeding ticket compared to a reckless driving ticket is a big deal to insurance companies.

After a quick google search, if you're a first time offender, they cap the fine at $100 in MS.

Honestly, if you're offered the fine and driving school to drop the ticket, I'd take that.

Thanks. I did a little digging and saw that there is no automatic speed for reckless driving in MS, and I only got the ticket for speeding.

I'd take the opportunity for driving school in a heartbeat, I just haven't found a definitive answer on if that will work with a MO license.

For what it's worth, if you don't take care of the ticket then MS will likely report it to your state and your license could be suspended as a result depending on Missouri law. I had this issue come up with a ticket in Tennessee where I mailed the money order in to pay for it (it was a little podunk department) and didn't find out they never processed the money order until I got a letter from Kentucky's department of transportation saying if I didn't pay it by X date my license would be suspended. And that was just on a speeding ticket going 10 over.

I travel and have had 20 tickets in my life and pay them all, at least the out of state ones.

There's a decent chance this never shows up on your MO license. Maybe call and say "I'll plead guilt and pay now if you drop it to 89mph".

You are correct that you can't get a "first time" off your record program with an out of state license.

There is an age loophole (I think it's under 21) where you can keep it off of your insurance and take a defensive driving instead. I got caught doing 85 in a 70 near Picayune and that's what I did. It also cut the ticket down to just over $100, with $50 for the class, which I was allowed to take back home in Louisiana. Could have been much worse.

Dont speed in Georgia. anything over 15+ mph over the posted speed limit is reckless driving. Not only do you get a fine and points, but you also get hammered by the states "super speeder" law which will hit you for another 200 bucks.

Having said that though, the GSP now mostly works the city of Atlanta (including suburban surface streets) because thats where they make the most money.

Call an attorney in Carthage and get him/her to represent you. Sometimes small town municipal court/justice court judges don't care that reckless driving cannot be given based solely on speed, and 92 in a 65 will probably draw some ire from the local judge, especially for someone from out-of-state.

I had a similar situation (MS license with a ticket in TN) hired a local lawyer for $300, and got a speeding/reckless endangerment ticket dropped to defective equipment. Saved me from any insurance problems.

Is there enough time to do that before next Monday?

Yes. Do it today (if offices are open) or tomorrow morning, though.

Unless something has changed recently, you can get driving school and pay for the school and the ticket is no longer on your record.

I got a ticket while at Ole Miss. Called the judge and sounded apologetic - didn't even have to show up for anything. If you're under 21, you can get the fine replaced with online driving school, and it will never show up on your insurance record. You may want to follow up with the clerk though to make sure it is correctly recorded. Found out 2 years later it was still on my record because of lazy office workers. You'll still have to pay court costs - that's all the city likely cares about anyways. Good luck

I've gotten like 4-5 speeding tickets and got them taken off from doing driving school every single time. I got them all in different parts of the state and I guess they didn't pick up on it in the system because they offered driving school each time.


Don't know about the out of state thing

Welp, called the court this morning and found out it's only gonna be a $190 ticket and I can do driving school for $45. Feel 12345678909876543 times better than I did when I thought I was losing my license or going to jail. Thanks to everybody in this thread for all the help anyway.
