He has already admitted he took impermissible benefits, it is now up to him to prove he paid him back. NCAA doesn't have to prove anything other than what the guy already admitted to. Paying it back doesn't mean it didn't happen.
Which means he didn't lie to the NCAA (see the Dez Bryant case).

Whether he lied to them or not doesn't really matter, he committed an NCAA violation. Like I said, I doubt much comes of it, but he still is on the hook for the violation.
