very common and the best tactics for drunk drivers. defense lawyers always encourages this. Without actual blood alcohol evidence, that frequently results in the dismissal of the DUI charges.

Lawyers tell you not to do anything but ask to speak with your lawyer. If you're fallen all over yourself doing field sobriety tests, it's hard to get it dropped. Especially if there is a video of the stop.
Has he actually signed a LOI?

it rarely ever gets dropped. but in most cases they do escape with way lesser penalties compared to taking a BAC test. I've seen so many people around me get off with a probation or plea bargain for lesser charges.

If he didn't blow, they probably will let him do some kind of diversion program if it is his first offense.

Douglas DUI story
Blount County authorities have charged a former Maryville High School and University of Tennessee football player with driving under the influence, according to intake reports and a Sheriff’s Office spokeswoman.
Aaron David Douglas, 21, Snowshill Way, Maryville, was released on a $1,000 bond pending a 9 a.m. Dec. 29 hearing in Blount County General Sessions Court, after being booked shortly after midnight today.
Sheriff’s Office spokeswoman Marian O’Briant also said he was cited with implied consent violation, according to the Sheriff’s report. That citation alleges that Douglas refused to submit to a blood alcohol test.
Authorities stopped Douglas on U.S. Highway 321 West near Partnership Park South, according to the report.
Deputies performed standard field sobriety tests, on which Douglas performed extremely poorly, according to O’Briant, who was reading information from the report. He was unsteady on his feet and uncooperative during the investigation, according to the report.
Former UT Football Coach Phillip Fulmer recruited Douglas to Tennessee from a stellar prep career at Maryville High School, that included being twice named Tennessee Mr. Football (lineman). Douglas red-shirted at UT in 2008, but earned a starting role at offense tackle in the 2009 season under Lane Kiffin, Fulmer’s replacement.
After two coaching changes in two seasons, Douglas withdrew from UT, asking current Coach Derek Dooley for his release in March. That move caused some controversy over the terms of the release and Douglas decided in May to go to Arizona Western Community College, which would then allow him to transfer to a four-year program with two full years of eligibility remaining.
After visiting the University of Alabama last month, Douglas recently said he had signed with the Crimson Tide and would enroll in classes at Alabama in 2011.

The kid can play. You'd think he'd keep his nose clean for 1-2 seasons with the potential he has. Hard to believe he hasn't realized his chances are running out. Very sad.

There is really nothing out in that area and not a hotbed of police activity there. Blount Co. would have had to have spotted him driving erratically coming out of Maryville and stopped him within 2 miles of City line.
Sad...Not surprised at all...but sad none the less.
Kid had all the chances in the world both in HS and at UT.
