I haven't seen where his BAC was released but alcohol is not required to be intoxicated.

1. Was he speeding? Yes
2. Was he driving while impaired? No. He was below legal limit
3. If he hadn’t been accused of driving while impaired, would he have been illegally possessing a firearm? No
