Not seeing it. I heard it from a few people heavily invested in basketball. Also, Wiley received a combine invite which isn’t much of a surprise.

He has tweeted he'd wear an arm sleeve for 2 years. I'll believe it when I see it

After the initial joke though, I've had to see it through. It was my show of support last year. Way better than all the other garbage people tweet at these kids

True, there's a good deal of uncertainty built into that "if." His wife also filed for divorce.

Now it appears something new has come to light according to Yahoo! writers Pat Forde, Dan Wetzel and Pete Thamel. A letter from Michel’s lawyer, Jonathan Bach, asks for “suspension of briefing” because the “government has advised that it intends to file a superseding indictment within the next 30 days.”

This means that the government could be adding new information to the original indictment. It will also likely “further clarify its theory of wire fraud,” which the government had stated it intended to do in a recent filing.


A new indictment could mean new charges or simply new information in the case. It remains unclear what those details might be. Person posted bond after his initial arrest, but had to surrender his passport.

The new indictment is in response to motions by Person + Michel to suppress wiretappings + dismiss charges. The government is likely releasing very little new info, just enough to fight off these motions

Basic breakdown of Person's dismissal arguments vs FBI/US Gov

Motion to Suppress Wiretaps and cell phone search evidence

(1) Wiretaps were 'unnecessary' . With the cooperating witness who orchestrated the crimes, govt didn't need wiretaps.

(2) Wiretaps were unlawful as they were not supported by probably cause.

a) Wiretap warrants granted based only on speculation Person was involved in other bribery schemes
b) The wiretap applications never suggested that "Person was paid with the specific intent" to effectively commit a crime
c) No clear evidence that phones were being used to commit a crime






Dismiss Corruption/Honest Services Fraud Charges:


Person's Arguments to Dismiss:


(1) Person was not acting as an agent of Auburn University/outside his employment responsibilities. Person was a private citizen on his "downtown and away from Auburn premises" recommended a financial adviser for when players went pro after school.

(3) What Person did was not even a federal crime and may be unconstitutional to prosecute as such. NCAA Amateurism rule violations do not fit statutory definition of corruption or 'viable theory of criminal liability'


US Govt Response:

US Attorney Geoffrey Berman said the motions were "a series of premature arguments that at their core turn on their views of the sufficiency of evidence at a trial that has not yet occurred"

Person's lawyer doesn't "understand the concept of agency."

While person is a giant POS for doing what he did and deserves to be fired and ostrisized from college b-ball forever, is this a clear federal crime?

Even if it is a fender alignment crime, is this really worth the full weight of the justice dept coming down on an assist b-ball coach for cashing what amounted to relatively small sums of money?
