Here's what probably happened from a Defense Attorney perspective:
1. The Defense attorney and ADA clearly worked out a plea agreement, and probably spent a good deal of time on it with provisions for therapy and mental health evaluations so that she's doesn't reoffend.
2. This is the standard practice, we usually don't run every plea agreement by the Judge before submitting. I do this on occasion when I have a problematic client or a high level felony. For example, I had a Embezzlement case with corporate of a large restaurant chain where an Administrative Assistant siphoned about $200K to a personal bank account over the period of about 6 years before being caught. We ended up getting the State to agree to diversion and dismissal after a long probationary period. I absolutely met with the Judge in chambers before presenting the agreement because of the level of charges and media coverage(which is rare).
3. This Defense attorney probably did not think this was necessary because the stalking is a Misdemeanor offense and they stacked a bunch of conditions on top of her probation. I'm also assuming she is a first time offender(or first time in court :lol:)
4. Because there was Media in the courtroom (because she is "attractive for viewers") the Judge decided that he would exercise his purview over sentencing and add a week in jail.
5. I've had Judge's disagree with an agreement we submitted. Their reaction has alway been to inform the parties that the plea agreement would not be accepted. Never has a Judge imposed a no bargained jail sentence.
6. It "feels" like the Judge felt disrespected that the attorneys did not give him a heads up privately, and decided to show off for the camera. It will probably make him look good with the voting base, but he will lose a ton of respect with both Defense attorneys and the State attorneys who will both look at this as an attack on their ability to do their job.
7. Telling the Defense attorney that this occurred due to his "poor practice" was out of line. A motion to withdraw the plea is a reasonable request, and it will probably be granted on appeal. All this is doing is making the attorney file emergency motions to keep the woman out of jail pending the appeal, which will likely be granted.
8. By the way the attorney carried himself, I doubt he has much pull. Some attorneys would cut a fat check to a challenger for the Judge's seat after behavior like that. Its usually why Judges only pull this on cases with a public defender or appointed counsel.
