It is if he had no knowledge that the gun was in his car, genius.
It's up to the legal system to determine if he intentionally drove the gun to the scene for the expressed purpose of aiding and abetting his teammates in a physical altercation. Innocent until proven guilty. As of today, the legal system has determined that he did not in fact do that.

Exactly which is why he should have been suspended immediately. Not let go after a 45 minute investigation.

Except he brought them the gun used and they were in the back of his car talking about how it was loaded.
But sure, as bullets were hitting his car I’m sure he had no clue who was doing the shooting.
