"He had a sad story," Police spokesman said, according to the paper. "He had recently been released from prison, he had a bad heart, and he didn't care. He kept insinuating that he wasn't going to take no for an answer."
Updyke, who is also wanted in Alabama for violating parole, is scheduled to stand trial Oct. 1. He is accused of destroying one of the most beloved of all West Virginia athletic traditions, The Mountaineer statue. Updyke has pleaded not guilty by reason of mental disease or defect on charges that include criminal mischief and desecrating and destruction of state property.
