I agree Tideprice - however it will never go away.
people just can't let shite go - and it devolves into a pissing contest.
he did it, fine him, put him on probation - grow some new trees and let the shite go.

Please pardon me for asking an honest, serious question.
On what basis is this particular charge based? I thought that Toomer's Corner was within the city limits of Auburn and not on the Auburn University campus. If so, the trees aren't on an animal or crop facility. So if that's the case, will they try and make the case that the original trees came from Auburn and were planted there...justifying the charge that the trees came from an animal or crop facility?

They are on campus, now if there is an easment based upon the roadway/sidewalk thats another question. But they are on the corner of the edge of campus

Doesn't the City of Auburn clean up the toilet paper?

I don't care what they decide to do to him, but seeing how partisan the Bama fans are when he obviously did something villainous just makes me realize how ridiculous some people are.
Speaking of ridiculous, how about some Auburn fans who complained that Alabama fans were being "attention whores" for bringing awareness to the damage the tornado did in Tuscaloosa? The insinuation being that attention was selfishly being sought by Tuscaloosans/Bammers at the expense of other damaged areas of the state and that Alabama was milking the publicity for sympathy. Yet it wasn't attention whoring for sympathy on the part of Auburn fans trying to equate the Toomer's Oak "tragedy" with what happened in Tuscaloosa.
As for Updyke, he should be fully prosecuted. Although they are trees, they are a vital part of Auburn's tradition and the crime is more serious than killing "a couple of trees".

I'd consider them a monument.
I would too if my only other option was a "place of worship".

You will get a kick out of this. No, actually a bunch of bama fans do. Subcontractor from montgomery I believe
Now that's funny! Hope they're well paid.
So...then the university must pay them and not the city.

I was going more on the definition of "monument" than the other option.

quote:
A monument is a type of structure either explicitly created to commemorate a person or important event or which has become important to a social group as a part of their remembrance of historic times or cultural heritage, or simply as an example of historic architecture.

Also, the city of Auburn's police department had jurisdiction over the investigation and were the ones who made the arrest. In addition, the City of Auburn's website says that they are a city landmark. I understand that the trees are basically where the campus begins, but everything I have read so far indicates that the trees aren't technically on the campus. If that is the case, this charge won't stand.

There is no Auburn University Police Department anymore. Was eliminated about 7 or 8 years ago.

As they do over the entire campus. Auburn got rid or merged the campus police several(about 10) years ago

Just guessing but I bet Harvey used a 4lb bag, but probably didn't haul around 20 gallons of water with him though. So what ever he mixed up was pretty damn concentrate. So I'm just gonna go out on a limb and say dumping something that concentrated into such a small area qualifies as a massive amount. Just my uneducated opinion though.
You do realize that 90% of people that use pesticide or herbicide chemicals, such as roundup or spike, very regularly use a much higher dose than what the label says right? Hell, when I use roundup to kill weeds around my house and store, I usually use 5 or 6 times as much as I'm supposed to in a 2 gallon pump sprayer, and as a manager of a business that sells these types of chemicals at retail I can tell u that almost every customer I have talked to about it uses way more than the recomended amount.
Using a higher than recommended amount will be a hard prosecution and doesn't really carry the horrible "federal" ramifications u seem to think it does.

What one person says really gets to you doesn't it. Here is a tip, dont' go to ITAT, dont' believe what posters at tide fans say auburn fans said...and finally don't get bent out of shape so easily.

Just did a quick search as well, clean up is contracted by Auburn University, not the city.
They are a city landmark as the university is not it's own municipality

Thanks to the Alabama Farm Bureau here in Alabama we have a lot of laws designed to "protect" farmers and farm land. Most of them suck

Not really, I just enjoy pointing out hypocrisy. Maybe I'm wrong for enjoying that but I get a kick out of it. I didn't say all Auburn fans were saying this. A few Auburn fans on ITAT called others out but it was a strong sentiment on some Auburn message boards.
