The prosecution is engaging in excessive political posturing. This is a misdemeanor with a fine of no more than 500 bucks for killing any tree in Alabama besides this one. Updyke is a crazy bammer, but there is no reason for my tax money to go towards 250,000 dollars worth of jail time for this loon who killed a tree. Not to mention all of the government provided healthcare he will have to be given while in prison.

He should certainly be ordered to pay the cost of restoring the area to its prior state. Would he ever have enough money to do that? Doubtful. But it should still be part of the sentencing.

That's an entirely different debate, but I doubt you'd give two shits about the political posturing if it favored Bama.

He attacked one of the purest traditions of Auburn and frankly no "reasonable" punishment makes it right.

I don't care what they decide to do to him, but seeing how partisan the Bama fans are when he obviously did something villainous just makes me realize how ridiculous some people are.

Doesn't this occur every time Auburn wins a game? There isn't an "acceptable desecration" and an "unacceptable desecration" line.

Try the guy and if found guilty make him serve an proper punishment but thiss could be used for anyone that hangs faux auburn jerseys on Coach Bryant statues as well.

I hate to break it to you Slim, but the DA "over" prosecutes everyone.

It has gotten to the point where it isn't about doing what's just and right... it's about pumping up their stats and justifying their jobs.

*This is a general rant and has nothing to do with my feelings about Updyke, in particular.

When a man pours herbicide on a tree and the DA digs up some antiquated farmer protection law to charge him with "damaging property on or from an animal or crop facility", yes I would say that is ridiculous.
