I think we've resolved all of the Auburn questions for now. Good job, especially to all of the friends and boosters of the University of Alabama.
Well, I think I just figured out where CFB223483927 got his misguided angle from. This is from Clay Travis.

Then one hour before its release of this official disassociation letter Alabama responded to my Freedom of Information request seeking any emails Nick Saban might have sent or received about T-Town Menswear, his players signing autographs, or Tom Albetar with this cryptic, suspicious and nonsensical denial of that request: "
So, he tried to use a FoIA request.
Then, UA said this.
quote:
"Mr. Travis: After reviewing your request, it is our opinion that, based on the law of Alabama, court decisions interpreting that law and opinions by the Attorney General, the University does not have public records that are responsive to your request
Hmmm...could it be that Clay Travis, Esq. filed the wrong damn thing? FoIA request are for items controlled by the Feds. If he, like the al.com print media group, had filed a proper Alabama Open Records Law request (which deals with state entities)...then maybe they would have complied. It looks like UA compliance/legal just stonewalled him because he filed the wrong thing.

quote:I think you may be right. Also, I'm not familiar with all of the exclusions/exceptions of the sunshine laws in bama, but I would think emails may be protected to some extent. I also suspect Bama's general counsel is copied on any email discussing such issues so that bama can make an attorney/client privilege claim.

ETA: Which raises the question in my mind of whether seeking "legal" advice related to NCAA compliance issues is protected by the attorney client privilege. My educated guess is that it is.

Yeah, but you have been drinking. So, much like the young ladies who have partaken in strong drink around me...I don't believe a word that comes out of you mouth.

In your current state, I have a feeling you can't even make out the letters let alone read it.

THey are on a first name basis, so I'm sure you can ask him and he'll know exactly what you are talking about. I know nothing about public records, but I do know that when someone requests records for my line of work, and they don't word them broadly enough, or with the correct wording, we don't have to comply.

I always feel like, if you can avoid giving information, regardless of guilt, it's always best. Good for Alabama.

Another gem from him.
I guess he was thinking about college football when they covered Erie Railroad in 1L.

So is the state of Alabama's position really that the freedom of information act doesn't apply to the state? Apparently so. And if that's the position, doesn't it really make you wonder what those emails might say?

I really enjoyed the argument that the letter couldn't be verified because it was hand delivered.
