You are still describing the situation incorrectly. The NCAA granted waivers for extra years of eligibility for players prior to 2022. Then the NCAA granted 5 for 5 to players after 2022. The 2022 players, rightfully so, petitioned the NCAA for an extra year, particularly since the rule was put in place after the players had no choice but to test the pro market.
Judges agree it was handled incorrectly. Sankey is not fighting it at this point. The NCAA is not fighting it right now. Pretty much everyone agrees those players were cut short unneccessarily.

However, you are correct in that this needs to be codified in a CBA to prevent that.

What about the tens of thousands of former players who didn’t take a redshirt season and were limited to only 4 years of eligibility? Before the June 2026 5 for 5 ruling this was the system in place for decades - players got 4 years of eligibility unless they redshirted.
Should these tens of thousands, maybe hundreds of thousands, of former players be granted a 5th year of eligibility too? Because if these current 2022 players win you know one of these earlier players will be next to file a lawsuit arguing they should be given another year of eligibility.

lot of marginal draft tier athletes may test the waters as UDFA and enter minicamps after their 4th year and later attempt a 5th year of college if it doesn't pan out.
