You're right about that. I never attended Tulane (or is that Temple?)

I did however attend and graduate from The University of Texas at Austin from Fall 2010 - Spring 2014.

If true, that guy is also a piece of shite. I'll gladly tell him that if he posts here.

However, Daniel actually does post here as texag7, so it's only fair to remind him what a racist POS he is when he's acting like a reject douche (like in this thread currently).

Daniel - I know. Tulane is in New Orleans and Temple is in Philidelphia (I honestly don't know which one you're referring to but I attended neither)

First off, it wasn't his daughter he is alleged to have assaulted. It's his fiancé

It's also possible it wasn't an actual "choking" at all. Choking is an automatic felony ag assault charge here too, but I had a client a couple of years ago place his hand on his wife's collar bone to calm her down. He wasn't squeezing her neck, choking her, etc. She was having a meltdown and starting to get physical, so he was trying to calm down the situation and prevent her from further aggression. Right after, she told him something like "I got you now." These people were in the middle of a toxic divorce litigation. Guy was charged with ag assault strangulation after she lied to the cops and said he strangled her. Charges ended up getting dropped, but that's not something that typically happens within days of the criminal complaint either.

This is what Beard's fiance said happened

"He just snapped on me and became super violent," she said, according to the affidavit.

The woman said she took Beard's reading glasses from his hand and broke them. Beard, she told police, then slapped her glasses from her face.

Then Beard, "choked me, threw me off the bed, bit me, bruises all over my leg, throwing me around, and going nuts" she said, according to the affidavit.

The woman told police that Beard put an arm around her neck while he was behind her and choked her for five seconds, impeding her breathing.

Beard, while police were on scene, said he had audio recordings of the incident that show he was not the primary aggressor. Police say Beard was not willing to share the recordings.

The following injuries were visible on the woman, according to the affidavit: bite mark to the right forearm, abrasion to the right eyebrow, abrasion to the left leg from the knee to the foot, and a cut to the left thumb with dried blood. In an additional statement, the woman complained of scratches on her back and her right eye, a bite mark to her right arm, an abrasion and bruises to her left leg, and a cut to her left hand.

Beard and the woman have been together for six years and engaged for three years, according to the affidavit. They share the same residence.



What stands out to me is why she would have a bite mark on her forearm. My first instinct to how that would happen is she was behind him with her arm around his neck, and he bit her to get her to let go. I'm not saying he didn't assault his fiancé, but we're relying on one person's statement of how the altercation went down. Her having physical injuries doesn't mean she wasn't the primary aggressor nor does it mean he choked her. There wasn't anything said about visible marks on her neck area, which also stands out to me. Just reading that and without any prior history of domestic violence in the relationship (at least that's been alleged thus far), those facts just don't line up to me. Generally speaking, people his age with no prior violent history don't just snap and start choking people over some reading glasses. Not saying it's impossible, but I think there are likely a lot of missing details.

That said, I do think he should, at minimum, be placed on administrative leave pending the investigation and disposition of the criminal matter, which should be SOP whenever something like this happens.
