While true, it's always a lawsuit away from being overruled. The winter transfer window was from Dec 9-28, and Nico was the starting QB for a CFP team. He could very well ask for an exception if he wanted the SEC.
That said, I'd bet it's West Coast (UCLA, USC or Oregon in that order) or Big (Michigan) with deepest pockets and unsettled QB situations

The SEC put in place a Feb 1 date for transferring for fall eligibilty in 2021. Nico chose to attend Tennessee, with full knowledge of that rule, over similar institutions without that rule in place. Unlike the NCAA rules where there are no alternative organizations to play college sports, he chose to attend an SEC organization knowing the inter-conference transfer limitations. He could have attended any Big 10, ACC, or Big 12 school who are all similarly situated. This would be akin to an athlete choosing to attend an Ivy League School and then suing because he wants to be on an athletic scholarship knowing full well that Ivy League Schools do not offer athletic aid.

Yes, although the latter part of your position is a bit of a logical fallacy, all things can be litigated.
And, in the current era, players have come out very well in arguments over NIL, transfer portal, and additional eligibility. I don't think anything is off the table should his team choose to pursue it. That said, I also don't think he is the talent he thinks he is, and SEC school's see that. So, the liklihood is low that he would be an intraconference transfer for the money he wants even if eligible
