And yet with a little good legal advice, they could have done both, salvage the class and avoid suit. Though that doesn't avoid the problem about misleading the press, the public and the recruits, about the violations. It was clumsily handled at best.
I do suspect that if Freeze was the source, he well may not have seen the severance contract with Nutt, but I would think Bjork either had seen it or was made aware of its terms. And at the very least, once the press cited Ole Miss sources, implicating Nutt, counsel or some one should have done immediate damage control.

Sooooo if someone, say the rebelrags folks, put in a FOIA for mullins, and other msu officials phone records you would be all "give it to them. No big deal". Right??
Im sure msu would try to find a way not to, and put a price tag on all the work it takes to fulfill the need.

Yes, that's how the FOIA works. Most people don't use their work phones to call hookers though, so I doubt MSU would hesitate to give the records out.

An Arkansas fan FOIA'd Nutt's phone record while he was here, not much came from it except a few texts and calls to a local television personality at odd times including a few minutes before kick off of the sec-c and bowl game, an affair was inferred on message boards but nothing was ever proven.
The media FOIA'd Petrinos phone records, nothing came of it and he was proven to have had an affair but is smart enough to use a few bucks from his large salary to have a private phone not subject to FOIA.

Yet they think of themselves as a "lawyer" school.
In my opinion they could have avoid a large amount of this by just fessing up early, doing a mea culpa and firing some random low level assistant coach.
This will end up being required reading as a case study in "how not to deal with the ncaa.".
On a related note, at first Nutt just wanted an apology, at this point, with blood in the water, how high does the settlement go, just to not have this go to court?
