I know what you mean. With the Old School you knew where things stood and how they were and could take appropriate steps. With the New School they hide it as best they can and that kind of racism can be more insidious because it never gets addressed in the light of day.

I'm not sure if the University is able to civilly or criminally prosecute a student for trespassing.
Apparently the University wants to prosecute them under federal hate crime statutes which will obviously raise larger First Amendment claims, which raises a myriad of confusing issues. I'd love to hop on this gravy train

No doubt it would be an interesting case that would go on for a while unless they cut a deal. My criminal justice prof. always used to say that campuses were like Indian Reservations in terms of jurisdiction and the complexity of rules and the multiple laws that can be applied.

The University is publicly funded....so that means this was defacing government property.

Right, which is the last statute I posted.
Any competent defense attorney would motion to dismiss because the federal "hate crime" statute the University is seeking to prosecute under is overly broad. Also, any competent defense attorney would immediately raise a First Amendment claim as well.

Seriously, how far along are you? I took a few law courses in grad school. Since I've already got law school credit I've been thinking of going back and getting a JD but right now I'm too lazy to study for the LSAT.

Likely upper middle to upper class white college students; I'd raise every single First Amendment claim possible; this incident will likely be subjected to ADRs as well.

If these guys live in a dorm, a fraternity house, or have another room mate or any guests into their house (the later of which is least likely), I don't see how they could keep it a secret if they even tried. Someone is going to notice that that flag is gone, and won't hesitate to turn them in for 25k. It would have to be in my very inner circle of friends to even consider not turning them in for such a price, and even then I'd be highly questioning if I wanted to continue being friends with them.
That said, no way these dumb fricks didn't brag about it the second it happened. Everyone on campus is going to be looking for a dumb Georgia male to where tracking him down shouldn't be all that difficult.

Ah so you're still in the grind work. Upper level courses are more fun.
I've always wanted a law degree. I have no idea why I didn't just go for it when I finished grad school. It opens up a lot of options.
