If I'm guessing correctly, vandalism must result in some sort of damage.

Westlaw is taking forever but I'm going to post the Mississippi vandalism statute once it loads.

Also, keep in mind that this incident may have occurred in a free speech area, is on the campus of a state-owned university, and involved a monument/statute, so there may be a controlling federal statute or case law on point, which I don't care to research since no one is paying me for it

Also, I'm not going to look up particular cases of vandalism of statutes in Mississippi.

I don't know all of the statutes that could potentially be involved in this case, but generally speaking, hate crime statutes involve crimes targeted at a specific victim and not something as broad as this, which, if defending these two morons,I would classify as protected political/social speech.

My thing is this:


Most likely, some bag of douche had a Georgia state flag hanging in their room and it isnt there now. That alone could get people talking. Then throw in the fact that multiple people most likely knew about this and for every person that knows the chance of it spreading goes up exponentially. People have a hard time keeping their mouthes shut.


And this isnt even taking into account the high likelihood of them being on caught on camera at some point.

Hoping they do. And the people that did this are obviously dumb enough to make mistakes due to the things they yelled as they walked away, but we'll see.

And I'm still learning my way around the rant. Still a shite poster and not funny at all, as referenced by my awful first ever post (but then again, I guess that means I fit in). I just had to say something on this because it particularly pissed me off. I'm glad I didn't have an account yet when all the "riots" went down

I didn't think it had to be a specific person. Like if someone goes and spray paints swastikas on a Synagogue.

Don't know for sure. I think there is a federal act regarding hate crimes and probably 40-50 different state laws dealing with the issue. I haven't read a single one, so you might be right.

Miss. Code Ann. 97-17-67 - Malicious Mischief

(1) Every person who shall maliciously or mischievously destroy, disfigure, or injure, or cause to be destroyed, disfigured, or injured, any property of another, either real or personal, shall be guilty of malicious mischief.

If this is the controlling statute, which it's unlikely considering the circumstances of the incident, the perpetrators cannot be charged criminally or civilly.

Miss. Code Ann. 37-11-19 - Injuring school property

If any pupil shall willfully destroy, cut, deface, damage, or injure any school building, equipment or other school property he shall be liable to suspension or expulsion and his parents or person or persons in loco parentis shall be liable for all damages.

Miss. Code Ann. 65-7-23 - Signs, traffic control devices, memorials, cultural or historical markers; damaging; offense: penalties

(1) 1) Any person willfully defacing, removing, marring, damaging or destroying any sign or guide board, including any railroad crossing sign or flasher signal, or other traffic control device erected as provided shall be guilty of a misdemeanor and, upon conviction thereof, shall be liable for the actual cost of replacing or repairing such sign and shall be fined not less than Two Hundred Dollars ($200.00) nor more than Five Hundred Dollars ($500.00), or be imprisoned in the county jail not more than six (6) months, or be punished by both such fine and imprisonment. If the offender is a minor, the parents of such minor shall be civilly liable in accordance with Section 93-13-2 for the actual cost of replacing or repairing the sign, signal or device.
