They cited the late 80's/early 90's Billy Brewer NCAA case as evidence of lack of institution control in the 2016 sanctions. Most of the people involved in that one were dead in 2016. They may not win in the long run but that won't stop them from trying.

The NCAA has had an erection for us for most of my life. Watching them die will be very satisfying. Salt the earth there in Indianapolis so nothing can grow back in it's place.
