Person died too so that's a Class B Felony in NV. It carries a maximum sentence of 20 years.

2. A prosecuting attorney shall not dismiss a charge of violating the provisions of subsection 1 in exchange for a plea of guilty, guilty but mentally ill or nolo contendere to a lesser charge or for any other reason unless the attorney knows or it is obvious that the charge is not supported by probable cause or cannot be proved at the time of trial. A sentence imposed pursuant to subsection 1 may not be suspended nor may probation be granted.
This part is especially problematic for Ruggs. Ostensibly can’t plead to a lesser offense and can’t have his sentence suspended nor may he get probation.

Seems unenforceable. What's the prescribed penalty for a DA dismissing a charge in such a way? Appears to be none. If so, "a prosecuting attorney shall not" is basically a recommendation.

Even if the toxicology report comes back clean, he'll still be charged with vehicular manslaughter, at minimum, more than likely (which is actually a misdemeanor in NV fwiw). Whatever the case, things like this don't get resolved quickly criminally or civilly. He'll be dealing with this, in some respect, for years probably

Correct, it’s easier to walk a DUI back then seek a charge later.

Fact is we don’t know if he was over the limit, under, totally shitface, high, whatever. It will all come out in the blood.

However, like most of these dudes he probably speed dialed his lawyer, got quick advice and prolonged that blood draw as long as possible.

And prosecutors will likely use retrograde extrapolation to show probable BAC at the time the accident occurred. There will be toxicology experts on both sides of this do all sorts of science-ing

No sympathy, don't care who you are. Drive impaired then suffer the consequences.

Can't believe with his money he would put himself in this situation with Uber, lyft, etc.

Maximum sentence, he took a life because of his stupid decision to drive!

Apparently the driver and her dog burned alive. I don’t know how to link the article, but I just read:

The Toyota burst into flames and the driver and her dog died, police said. The woman was not immediately identified.

Just sad. Not many good ways to go, but this is a particularly bad way.

May God be with her family.

Typical product of the Saban process. Trash thinks he is above the law. Now he kills someone.

Former Raiders wide receiver Henry Ruggs is expected to face a judge Wednesday morning after being jailed on felony charges. Ruggs, 22, was booked into the Clark County Detention Center on charges of DUI resulting in death and reckless driving. He is scheduled to appear at 9 a.m. Wednesday in Las Vegas Justice Court.

quote:

The woman [victim], described by Metro as a Las Vegas resident, was pronounced dead at the scene of the crash. The Clark County coroner’s office is expected to release the woman’s name after her relatives have been notified.

Police said Ruggs and his girlfriend, who share a young daughter, were treated for “serious” injuries at University Medical Center before Ruggs was transferred to the county jail in downtown Las Vegas. According to Metro records, Ruggs arrived at the jail shortly after 2:10 p.m. and remained in custody as of Tuesday evening.

A video posted Monday night to the football player’s public Snapchat account showed that he was at Topgolf Las Vegas hours before the crash. Authorities have not said where Ruggs and his girlfriend were headed at the time of the crash, but according to county property records, they were a few miles away from the football player’s $1.1 million home when the crash occurred.

Summary article—what we know so far:

My father was killed by a drunk driver. This was 1968 and I had turned 5 years old 12 days before. It left my mother with a 5 year old, 2 additional sons (twins) who would turn 13 a mere 15 days later, and my sister who had turned 14 just 6 weeks before. Mama didn't work at the time, this is when mothers were more apt to raise children in the home than work outside. But Mama did go to work. All 4 of us kids had chores to do... so yes, don't let today's kids tell you a 5 year old can't sweep and fold clothes. We had gardening areas and neighbors who owned tractors and implements to turn soil. They wouldn't even let Mama pay for the fuel, but Mama did make sure we helped them in their gardens. I guess there is a lot to be said for living in rural areas after all. I don't know what my life would have been like growing up with a Father. I do have memories of him and they are all good. I know you can't replace good Mothers.

I haven't seen much about the person who died. Thanks God there were no children in the vehicles. I do pray if there are children involved, they have a strong family because it will take it.

There is no acceptable reason to drive under the influence. Times have changed so much since 1968. The person who killed my father was never even arrested. "He was drunk... He didn't know what he was doing". I'm glad those things have changed.
