But crimsonsaint is proceeding under the flawed premise that someone would teabag a random stranger without more. This particular case appears to be a Bama fan that wanted to humiliate an LSU fan, but doesn't have the integrity to fight someone or even pick on someone who is conscious.

Have always been surprised that Louisiana has such narrow sex laws... in Alabama, there is a statute for lewd behavior that this would likely fall under. That said, Louisiana's drinking laws put other southern states to shame.

I think the Catholic influence is to thank for both.

It's very indicative of what type of person you must be that you have stated multiple times in this thread how funny you think the whole incident is, regardless of the legal repercussions.

That is a bit of misinformation. He was charged with sexual battery, not rape. He pleaded guilty to two obscenity charges.

I actually agree with you. For lack of a better way of saying it, the sex offender registry in this state is way too strict, and a lot of people end up on it that shouldn't be.

There are a lot of things I don't understand about our state laws.


This is also why it's huge that he won't end up on it and will likely be back home next summer. It took me more time to clean up my first offense DUI than it will for him to get this taken care of.

Right... this likely wouldn't be sexual battery in the state of Alabama, and as such, he wouldn't risk the sex offender registry.

Rape is considered a crime of power, but it is still sexual assault. No one deserves to have anyone's sexual organs on them unless they want them... so in the same way, while this may not have been a sexually motivated crime, it's still sexual in nature and should be prosecuted as such. If Louisiana sex laws don't allow for sexual nuances, so be it. He shouldn't have been putting his balls on someone.

My Bama DA friends have tons of stories about overcharging to secure, favorable plea deals. It is what just about every DA/State Attorney's office in the country does.

Here they charged with SB, pleaded him down to obscenity and got a nice win.

This is what I meant by narrow sex laws. Streaking can put someone on the sexual offender registry as well, if someone doesn't have a good lawyer. There is a lot of room to charge someone with sexual assault or battery in Louisiana.

As it is, it's like saying, "in Texas the speed limit is 85 where I live". In New York, there are places where the speed limit is still 55. If you are caught speeding, saying that the speed limit is too slow in New York may be a valid point, but it doesn't keep you from getting the ticket and paying the fine.

They have more statutes to choose from there. The motivation is still the same though.

Incidentally, had he been stuck with the sex offender status, if the criteria in Alabama don't fit, he wouldn't have had to register there.
